Heard learned counsel for the applicant and learned A.G.A. for the State.
Learned A.G.A. has raised a preliminary objection that against the impugned orders dated 10.8.2018 passed by Additional Chief Judicial Magistrate, Khurja, Bulandshahr and 24.4.2019 passed by Additional Sessions Judge, Court No. 2, Bulandshahr, the present application is not maintainable and remedy is available to the applicant to file revision under Section 397/401 Cr.P.C. in light of the order passed by a Division Bench of this Court in the case of Dinesh Kumar Yadav Vs. State of U.P. and another, 2016 LawSuit(All) 3378 which could not be disputed by learned counsel for the applicant.
The application is dismissed with liberty to the applicant to approach competent court, if so advised.
Office is directed to return the certified copy of the impugned order to the learned counsel for the applicant after keeping the photocopy of the same on record.
