JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) It has been submitted by Mr.Shah that initially, the application was prepared by showing the name of the insurance company as applicant since it was seeking for condonation of delay, but on account of the insistence by the office, the another application is redrafted with the format of Cross Objection.
We find that there is no material for such purpose, but even if it is so, the same is a wrong approach because the party who is seeking condonation of delay has to stand as an applicant and the remaining parties may be opponents.
At this stage, Mr.Shah seeks permission to withdraw the present application.
Permission granted. Disposed of as withdrawn. It is observed that the present order shall not operate as a bar in filing the another application for condonation of delay.
