Petitioner is accused in Crime No.03 of 2014 of the Kayamkulam Excise Range Office for the offence punishable under Section 8(1) and (2) of the Kerala Abkari Act for alleged possession of 5 liters of arrack on 09.01.2014, is in custody from 27.04.2014 and seeks bail.
2. Application is opposed by the learned Public Prosecutor. It is submitted that the contraband was seized from the possession of the petitioner on the relevant day, time and place. Petitioner is involved in 4 other cases of similar nature.
3. Learned counsel has requested for bail.
4. Having regard to the relevant circumstances and since investigation is in the preliminary stage, request for bail cannot be allowed at this stage.
Application is dismissed without prejudice to the petitioner moving again after the investigation has progressed.
