Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed with a prayer to quash the order dated 22.1.2021 passed by Additional District Judge, Court No.9, Kanpur Nagar, in Criminal appeal No. 70 of 2020 (Brijesh Kumar Yadav vs. State of U.P. and others), u/s 148(3) N.I. Act.
After arguing at length, learned counsel for the applicants has submitted that he does not want to press other prayers made in the prayer clause and has only made a prayer for expeditious disposal of Criminal Appeal No. 70 of 2020.
Considering the fact that the trial has remained pending since 2020, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of four months from the date of production of a certified/computer generated copy of this order, if there is no other legal impediment.
