Heard learned counsel for the petitioner and learned Standing Counsel for the State.
By way of this writ petition, the petitioner has prayed the following prayer:-
"I. Issue a writ, order or direction in the nature of Certiorari quashing the order dated 19/20.08.2020 and penalty order dated 19.02.2021."
Learned counsel for the petitioner submitted that the petitioner was not dealing with any kind of illegal mining activities of mines and minerals. He further submitted that the petitioner was removing the silt from canal so that irrigation water be made available to the people at large.
The authorities concerned shall re-consider the case of the petitioner within twelve weeks from today and till then the recovery may not be made if the petitioner is able to satisfy the authorities concerned that he was not dealing with any kind of illegal mining activities.
With these observations, this writ petition is partly allowed.
