----------------------- The petitioner’s vehicle bearing registration No.KL-8-AR-9342 has been seized alleging contravention of Kerala Minor Mineral Concession Rules, 1967. The petitioner submits that he has a valid to transport ordinary earth.
2. Considering the facts and circumstances, there shall be a direction to the respondent to release the vehicle of the petitioner on executing a simple bond with two sureties. However it is made clear that this will not stand in the way of authorities taking appropriate action against the petitioner if so warranted, including filing of complaint. It is also open for the petitioner to compound the offence, if he wants to do so. If the petitioner expresses his willingness to compound the offence, it shall be permitted on payment of Rs.25,000/- (Rupees Twenty five thousand only) The writ petition is disposed of as above.
