JUDGMENT / ORDER

K.Vinod Chandran, J. The petitioner contends that the petitioner has entered into marriage under the Special Marriage Act with the alleged detenue and that after marriage when they were living together in the marital home, the detenue was taken away by her mother and has not returned till date. The writ petition has been filed on the contention that the wife of the petitioner is in illegal custody of the respondents 3 and 4, who are the parents of the alleged detenue.
2. The detenue has been produced before us today and she categorically states that she does not intend to go with the petitioner and, according to her, it is not conducive to live in the petitioner's house.
WP(Crl).No.163 of 2014-S - 2 -
3. The petitioner seeks that he may be permitted to talk with the alleged detenue. In the circumstance of the alleged detenue having categorically submitted before us that she is not in illegal custody and wishes to return with her parents, we are not inclined to grant such permission.
In the above circumstances, the Writ Petition (Criminal) stands closed, however, leaving the remedies available to the petitioner, elsewhere.
