The wife is abroad working as a Nurse in Italy while the husband is an agriculturist in Muvattupuzha. The father of the wife has filed O.P.No.789/2013 on the file of the Family Court, Ottappalam. The same is for the custody of two children now aged 7 years and 3 years. 2. It is not in dispute that the children are with the husband (their father). The children may have to be brought to court at the time of trial. Their wish is a relevant factor at the time of considering the entitlement to guardianship.
3. The husband seeks a transfer from Family Court, Ottappalam to the Family Court, Muvattupuzha. But the father of the wife now aged 69 years is residing at Ottappalam. A travel to Muvattupuzha from Ottappalam would be tedious. Ernakulam has better connectivity for both the parties to commute.
4. I therefore transfer OP.No.789/2013 from the Family Court, Ottappalam to the Family Court, Ernakulam. The transferee court shall issue notice to Tr.P (C) No.587/2013 2 the parties and take the proceedings to a logical end.
The Transfer Petition is allowed.
