Petitioner has retired from the employment of respondent Nagar Nigam, Prayagraj on 30.1.2020. His other retiral benefits have been released but the amount of gratuity, leave encashment and insurance have not been paid to him.
Learned Standing Counsel submits that grievance of the petitioner would be examined and the amount due and payable to the petitioner would be released, expeditiously.
Law is settled that payment of retiral benefits is the entitlement of an employee for the past services rendered and is not a bounty. Such benefits cannot be withheld indefinitely.
In the facts and circumstances of the case, petitioner is permitted to raise his grievance before the respondent no. 2 alongwith copy of this order within three weeks from today. The respondent no. 2 shall get the facts inquired into and shall ensure that the withheld retiral benefits due and payable to petitioner be paid to him, within a further period of four months.
Subject to the observations made above, writ petition stands disposed of.
