This Appeal arises out of judgment and decree, dated 21.03.2014, in OS.No.97 of 2011, on the file of the Court of the learned Principal District Judge at Warangal.
Both the parties have jointly filed ASMP.No.1539 of 2014 for passing a compromise decree in terms of Memorandum of Compromise, dated 13-08-2014, annexed thereto. A perusal of the Memorandum of Compromise shows that it is signed by the appellants as well as their Counsel and the respondent himself (The respondent has not engaged any Counsel so far).
At the hearing, all the three appellants and the respondent are personally present and they have informed the Court that they have entered into compromise out of their free will and consent.
Mr.K.Sitaram, learned Counsel for the appellants, has handed over to the respondent, Demand Draft bearing No.869316, dated 12.08.2014, drawn on UCO Bank, Warangal Branch, for a sum of Rs.8,50,000/- (Rupees eight lakhs fifth thousand only), in terms of clause B of the Memorandum of Compromise.
In the light of the above facts, ASMP.No.1539 of 2014 is allowed and Memorandum of Compromise, dated 13-08-2014, is taken on record. Consequently, A.S.No.292 of 2014 is disposed of in terms of the said Memorandum of Compromise. Registry shall draft the decree in terms of the said Memorandum of Compromise.
As a sequel, interim order, dated 27-06-2014, is vacated and ASMP.No.117 of 2014, filed by the appellants for interim relief, is disposed of.
