Having heard learned counsel for the applicant, learned A.G.A for the State and perused the F.I.R. and rejection order, the allegations against the applicant are grievous and serious in nature in which it is stated that the applicant and co-accused Javed had gang raped the prosecutrix, he is being charged for the offence u/s 376-D IPC.
Taking into account of the allegation levelled against applicant, gravity of the crime and possibility of tampering with the prosecution evidence, I am not inclined to grant the bail to the applicant.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant Belal involved in Case Crime No. 0094 of 2019, u/s 376-D, 323, 506 IPC, P.S. Lohta, District Varanasi.
Accordingly, the anticipatory bail application is rejected.
