Petitioner has submitted an application for approval of Government approved test centers in terms of the provisions under the Legal Metrology Act, 2009 and the Rules framed thereunder. The complaint of the petitioner is that though as per guidelines issued by the Government on 08/10/2013 produced as Ext. P2, the concerned Director of Legal Metrology has to consider the application and pass appropriate orders and if it is refused, necessary intimation has to be given to the applicant, no action has been taken by the 3rd respondent so far. According to the petitioner, the application was submitted as early as in November 2013 and it is available in the office of the 3rd respondent as evidenced by the seal in the document, but no orders have been passed so far.
W.P.C.No.13405 of 2014 2 2. Heard the Learned Assistant Solicitor General and the learned counsel for the petitioner.
Having regard to the aforesaid submissions, I am of the view that this writ petition can be disposed as under:
The 3rd respondent shall consider and pass appropriate orders on Ext. P1 application within a period of one month from the date of receipt of a copy of this judgment.
