1. Petitioner had submitted Ext.P2 application before the District Collector seeking to release his vehicle bearing Reg.No.KL-52-B- 5189, which was seized by the first respondent on the allegation of having violated the provisions of the Kerala Paddy land and Wet Land Act, 2008.
2. According to the petitioner, it could only amount to violation of the provisions of the Kerala Minor Mineral Concession Rules, 1967 and the petitioner is entitled for compounding the alleged commission of offence in terms of Section 60(A)(1) of the above Rules.
3. Heard the learned counsel for the petitioner and the learned Government Pleader.
4. Having regard to the aforesaid submissions, this writ petition is disposed of directing the District Collector to consider Ext.P2 application and pass appropriate orders thereon, within a period of W.P.(C)No.13185/2014 -:2:-
fifteen days from the date of receipt of a copy of this judgment. If it is found that there is no violation of the provisions of the Kerala Paddy Land and Wet Land Act and if it is observed that the petitioner has violated any other provisions of law, the District Collector shall forward the files in this regard to the appropriate authority for taking necessary action, in accordance with law.
