Heard learned counsel for the petitioners and learned counsel for the State through video conferencing in view of the Covid-19 lockdown.
The present writ petition has been filed by the accused/ petitioners Beeru Singh & Ors. seeking issuance of a writ in the nature of certiorari quashing First Information Report bearing case crime no.0217 of 2021 under Sections 147, 148, 149, 323, 307 & 506 I.P.C. Police Station Lalganj, District Pratapgarh.
Prime facie, on a perusal of the impugned F.I.R. it cannot be said that no cognizable offence is made out against the petitioners at this stage. Therefore, no interference is called for in the matter. As regards the contention that there is a cross F.I.R. by the informant, the counsel for the informant informs that the petitioners have lodged the F.I.R. subsequently.
Be that as it may, merely because there is a cross F.I.R. that by itself is no ground for quashing the F.I.R. impugned herein.
We, accordingly, dismiss this writ petition but without prejudice to the petitioners' right in the pending investigation.
