Heard learned counsel for the petitioners and Mrs. Archana Singh, learned AGA-I. Shri Pramod Kumar Singh appears for respondent no.4.
Present writ petition has been preferred for a direction to Superintendent of Police, Kashganj to ensure fair investigation in the matter of FIR dated 26.5.2021 in Case Crime No.0095 of 2021 under Sections 363, 366, 323, 504, 506 IPC registered at P.S. Sikanderpur Vaishya, Distt. Kashganj and by procuring the arrest of respondent no.4 pursuant to aforesaid FIR.
On the matter being taken up today, learned AGA-I on the basis of instructions has apprised to the Court that initially the daughter of the petitioner-informant has made statement in favour of respondent no.4 but at the relevant point of time she was minor. Consequently she was sent to Nari Niketan. Eventually once she attained majority she made statement that she will go with her parents. As such her custody has been given to her parents. Therefore, it is submitted that the reliefs claimed in the writ petition no more survives.
In view of above, the writ petition is dismissed as having become infructuous.
