Learned counsel for the applicant submits that while the FIR had been lodged in the year 2014 and charge sheet has been submitted in the year 2016, the trial has remained pending because the first appearance of the accused has yet not been secured. In this regard, reference has been made in the order sheet to the learned Court below.
Considering the above, the present 482 Cr.P.C. application is disposed of with a direction to the learned Court below to take all coercive measure against the opposite party no.2 as may be permissible in law and to secure attendance of the accused under the pending trial and to seek expeditious disposal of the same without allowing for any long or undue adjournment Order Date :- 29.3.2018 Mini
