This application u/s 482 Cr.P.C. has been filed seeking the quashing of order dated 13.3.2019 passed by Additional Civil Judge, Senior Division, Court No.1, Additional Chief Judicial Magistrate, Gorakhpur in Criminal Misc. Case No.563 of 2019 (State through Leelawati Devi vs. Bechu and others), under section 156(3) Cr.P.C., Police Station- Barhalganj, District- Gorakhpur.
Heard applicants' counsel and learned A.G.A. for the State. Perused the record.
Learned counsel for the applicants has been fair enough to admit that the applicants are the proposed accused and in the light of view taken by full Bench decision of this Court in Father Thomas vs. State of U.P. reported in 2011 Cr.L.J. 2278 this application under section 482 Cr.P.C. on behalf of accused persons is not maintainable. Therefore it does not appear to be anything wrong in the impugned order which does not appear to have resulted in any kind of abuse of court's process.
The application therefore stands dismissed.
