Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 1580 of 2018 Applicant :- Bechan Ram And Another Opposite Party :- Sri Abhay Kumar Mishra, Suvb Divisional Magistrate Lalganj Counsel for Applicant :- R.K.Paramhans Singh
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant.
A writ petition preferred by the applicant was disposed of taking note of the contention raised before the said Court that although the petitioner had been allotted land, possession had not been given.
The Court notes that in the instant petition, it is clearly admitted that the applicant was in fact placed in possession and it was only subsequently that the private parties, who have not been arrayed as party respondents [and in respect of whom mention is made in paragraph 7] started interfering in his possession.
On this being the state of the record, this Court finds no ground to initiate proceedings in contempt against the opposite parties. It is accordingly dismissed.
