B.Devalakshmi vs Sathiya Bama

Madras High Court|01 February, 2017

JUDGMENT / ORDER

The petitioner has come forward with this contempt petition stating that the respondent/contemnor had willfully disobeyed the order passed by this Court in Crl.O.P.No.3020 of 2016 dated 29.02.2016.
2.Today, the contemnor is present before this Court and she has filed the records which would show that on 09.12.2016, the petitioner herself had appeared before the respondent police and given a letter stating that no action is necessary and that she only wants to get back her 13 sovereign jewels from her husband. Hence, no case has been registered against the accused.
3.However, the petitioner has come up with the present contempt petition stating that the respondent/contemnor had willfully disobeyed the order passed by this Court in Crl.O.P.No.3020 of 2016 dated 29.02.2016
4.Considering the submissions made by both sides, since the case has not been registered only on the basis of the letter given by the petitioner, I am of the view that no contempt is made out against the respondent. Hence, this contempt petition is closed. 01.02.2017 pgp R.MALA, J.
