B.Chinnayyan vs The Collector

Madras High Court|04 January, 2017

JUDGMENT / ORDER

By consent, this Writ Petition is taken up for final disposal.
2. The petitioners were appointed as Cook and Gardener by the second respondent and their appointment was done through sponsorship by Employment Exchange on 24.09.1987 and initially they were given consolidated pay of Rs.250/- per month. The petitioners would aver that from 01.12.1998 onwards, they have been brought to regular Time Scale of Pay and however, they have not been disbursed with salary admissible to a regular Government servant. The grievance expressed by the petitioners is that though they are serving from 1987 onwards, their services have not been regularized. The petitioners would further aver that the Directorate of Adi Dravidar Welfare, Chennai-5, has written a letter to the Headmaster of Adi Dravidar Welfare High School of Kalrampattu of Perambaulur District in Na.Ka.No.O3/19148/05-1 dated 14.08.2006 to send particulars for the purpose of considering the request for regularization of the services of the petitioners and it was also sent. However, the services of the petitioners are yet to be regularized, though they have been granted regular Time Scale of Pay as that of regular Government Servant. The petitioners had approached the respondents very many times seeking regularization of their services and since no response is forthcoming, came forward with this writ petition.
3.Heard the submissions of Mr.K.Dhananjayan, learned Special Government Pleader who accepts notice on behalf of the respondents.
4. Though the petitioners pray for larger relief, this Court in the light of the above facts and circumstances and without going into the merits of the same, permits the petitioners to submit a fresh representation to the second respondent along with a copy of this order as well as the recommendation/proposal of the second respondent dated 14.08.2006, within a period of two weeks from the date of receipt of a copy of this order and the second respondent, on receipt of the same, is directed to consider the same and pass orders on merits and in accordance with law within a period of ten weeks thereafter and communicate the decision taken, to the petitioners.
5. This Writ Petition is disposed of accordingly. No costs.
