JUDGMENT / ORDER

The Courts below have concurrently decreed the suit for fixation of boundary and for other consequential reliefs. The Courts below have in so doing relied on Ext. C1 report and Ext. C1(a) plan of the Advocate Commissioner. The Advocate Commissioner has sufficiently identified the property with reference to the title deed of the parties. The parties are siblings who are allotees under a partition deed fighting for over two decades. The finding of the Courts below are rested on evidence which calls for no interference in this Regular Second Appeal. There is a faint plea as regards adverse possession between the siblings. No issue is framed in that regard and there is also paucity of evidence to uphold that plea.
There is no question of law much less any substantial question of law in the regular second appeal. The regular second appeal is dismissed.
