Learned counsel for the applicant prays for one week time to file rejoinder affidavit. From the other side it is pointed out that the copy of the counter affidavit filed in this case was received on 19.11.2009 and as per initial order passed by this Court on 11.08.2009 rejoinder affidavit was supposed to has been filed within a week thereafter. Since then about two months have goneby. There does not appear to be any justification for giving time for the same. It is also pointed out that though the Sessions Trial is of the year 1998, probably all the evidence has already been adduced. At the initial stage of the filing of this petition an interim order was granted on the ground that according to the applicant the F.I.R. was not signed by the first informant and an application was also moved before the court below for comparison of the signature of the first informant on his expenses. But that prayer has been refused by the court below.
In view of the above, the time of one week to file rejoinder affidavit is granted but interim order is not extended.
