By order dated 24.1.2018 in Writ A No. 3000 of 2018 filed by the applicant, this Court directed the District Inspector of Schools to take decision after hearing the fourth respondent to the writ proceedings having regard to the decision in Sushil Kumar Yadav and another Versus State of U.P. and 3 others (Writ A No. 48244 of 2017) decided on 31.10.2017.
Counsel for the applicant submitted that certified copy of the order of writ Court was served in the office of opposite party on 7.2.2018 followed by reminders dated 2.3.2018 and 19.5.2018, but no decision has been taken in the matter so far.
This Court is of the opinion that before inaction on part of the opposite party in complying with the above direction is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order along with fresh representation before the opposite party and in which event, he shall ensure that compliance of the direction issued by the Writ Court is made within next six weeks. In case the compliance is still not made, as directed herein, it shall be open to the applicant to initiate fresh contempt proceedings against the opposite party.
