This petition, under Article 226 of the Constitution of India, has been filed with the following prayers:
"(A) Your Lordships may be pleased to issue a writ of mandamus or a writ in the nature of mandamus or any other appropriate writ, order or direction directing the respondent-Corporation to act as per the representation dated 08.04.2011 made on behalf of the petitioners (at Annexure-E hereto) and further be pleased to direct the respondent-Corporation to provide suitable alternative accommodation to the petitioners;
(B) During the pendency and final disposal of the present petition Your Lordships may be pleased to direct the respondent-Corporation to decide representation dated 08.04.2011 made on behalf of the petitioners (at Annexure-E hereto);
(C) Pass any such other and/or further orders that may be thought just and proper, in the facts and circumstances of the present case;"
At the outset, Mr.P.P.Majmudar, learned advocate for the petitioners, states that the interest of justice would be met, if respondent No.3
- Commissioner, Surat Municipal Corporation, is directed to consider and decide the representation made by the petitioners on 08.04.2011 (Annexure-E to the petition) within a stipulated period of time.
Upon the above statement being made by the learned advocate for the petitioners, the following order is passed:-
Respondent No.3, Commissioner, Surat Municipal Corporation, is directed to consider and decide the representation dated 08.04.2011, of the petitioners in proper perspective, and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
The petition is disposed of in the above terms, without entering into the merits of the case. Notice is discharged.
