JUDGMENT / ORDER

In this application the applicant has prayed to condone the delay of 60 days in filing the appeal on the ground that the applicant was not well versed with the procedure and after taking the advise of his advocate the decision is taken to file the appeal and, therefore, there is a delay.
While considering the case of the applicant for delay, this court has also prima facie perused the record of the case and, therefore, issuance of rule to other respondents was not necessary and accordingly, the application for condonation of delay was heard.
Considering the overall facts and circumstances the delay caused in filing the appeal for which sufficient cause is shown, prayer in terms of para 11(A) is granted.
This application is allowed accordingly.
Main matter to be heard on 27.6.2012.
