JUDGMENT / ORDER

Court No. - 33
Case :- WRIT - C No. - 19323 of 2019 Petitioner :- Batuk Prasad Yadav Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Hari Shanker,Sunil Kumar Singh Counsel for Respondent :- C.S.C.
Hon'ble Manoj Misra,J. Hon'ble Anil Kumar-IX,J.
The instant petition seeks a direction upon the second and third respondents to take appropriate decision on the representation of the petitioner for providing support to enable removal of building material/construction of Adarsh Junior High School.
It is the case of the petitioner that the land over which school building was constructed has been declared Charagaah and, therefore, the school building would have to be removed and the petitioner is interested in removing the building but there are other persons, who are resisting its removal.
Be that as it may, without expressing any opinion on the merits of the claim of the petitioner as also his entitlement over the construction material, we deem it appropriate to dispose off this petition by providing that the petitioner may ventilate his grievance before the second respondent (District Magistrate, Bhadohi). If any such representation is filed along with certified copy of this order, the District Magistrate, Bhadohi shall address the same after ascertaining the locus of the petitioner and pass a reasoned order thereupon, after hearing the other affected side, preferably, within next eight weeks.
