Heard learned counsel for the petitioner and Sri S.C.Dwivedi, learned Standing Counsel for the respondents.
Petitioner who is a village Pradhan is before this Court assailing the order impugned dated 14.1.2019 passed by the second respondent whereby financial and administrative powers of the petitioner has been seized.
This much is clearly reflected from the record that notice under Section 95(1)(h)(i) of U.P. Panchayat Raj Act has been issued to the petitioner on 20.11.2018 on the basis of preliminary enquiry report dated 3.11.2018 to which the petitioner has submitted a detailed reply on 28.12.2018 as such request has been made for finalisation of the enquiry which is undergoing.
In view of the above, without expressing any opinion on the merits of the issue and with the consent of the parties, this writ petition is disposed of finally with a direction to the competent authority to finalise the proceeding strictly, in accordance with law within a period of six weeks from the date of production of a certified copy of this order before him.
