THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.27628 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Panchayat Raj appearing for respondent No.1 and Sri M.S.R.Chandramurthy, learned standing counsel for District Water Management Agency, appearing for respondents 2 to 4.
This writ petition is filed, seeking a mandamus, declaring that the order passed by the 2nd respondent in proceedings No.FA/1465/2014, dated 17-7-2014 placing the petitioner temporarily out of employment as illegal, unjust and contrary to law and consequently direct the respondents to reinstate the petitioner into service with all consequential benefits.
The petitioner was appointed as Field Assistant on 3- 6-2006 in District Water Management Agency and a show cause notice dated 15-7-2014 was issued against him framing certain charges and thereafter, according to the petitioner, he was placed under suspension by order dated 17-7-2014. The grievance of the petitioner is that he was suspended on false charges at the instance of some of the villagers and therefore, he seeks to set aside the proceedings dated 17-7-2014.
The learned counsel appearing for the respondents would submit that pursuant to the show cause notice issued to the petitioner, he submitted explanation and after considering the explanation, the petitioner was placed under suspension and now the enquiry is under progress.
Since it is contended on behalf of the respondents that suspension order was passed by following the procedure, this Court is of the view that the writ petition can be disposed of by issuing a direction to the respondents to complete the enquiry within a prescribed period.
Accordingly, the writ petition is disposed of directing the respondents to complete the enquiry and pass final orders within a period of one month from the date of receipt of a copy of this order. There shall be no order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
