The case of the petitioner is that his Fair Price Dealership was suspended by the Sub-Collector, Madanapalle, Chittoor District – 3rd respondent, vide proceedings dated 23.06.2014 and subsequently after submission of explanation by the petitioner, the suspension was revoked by the 3rd respondent vide proceedings dated 06.08.2014, however, imposing a penalty of Rs.7,000/-. Against the same, one of the cardholders i.e. 5th respondent filed an appeal before the appellate Authority i.e. The Joint Collector-2nd respondent and the 2nd respondent vide proceedings dated 14.08.2014 granted stay of the operation of proceedings dated 06.08.2014 passed by the 3rd respondent. Aggrieved by the same, present writ petition is filed.
Heard both sides.
Since the appeal is pending before the Joint Collector-
2nd respondent, petitioner can raise all his contentions raised before this Court before the 2nd respondent, upon which, the 2nd respondent may consider the same and dispose of the appeal filed by the 5th respondent within a period of six weeks from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. No costs.
As a sequel, miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
