Heard Sri Chandra Bhan Gupta, learned counsel for the petitioners, learned Standing Counsel for the respondents No.1 and 2-State and Sri D.P. Singh, learned counsel for respondent No.3.
The petitioners have assailed the impugned award of the learned labour court dated 29.09.1997 passed in favour of respondent No. 3.
Sri Chandra Bhan Gupta, learned counsel for the petitioners and Sri D.P. Singh, learned counsel for respondent No.3 submit that both the parties, namely, the petitioner-employer M/s. Bata India Limited and the respondent No. 3-workman/Satish Chandra Srivastava have amicably arrived at a mutually accepted settlement and do not wish to continue the litigation any further. The terms of the settlement are as under:
I. The M/s Bata India Limited, Shastri Nagar, Sigra, Varanasi has unconditionally agreed to pay a sum of Rs.4 Lakhs to the respondent No. 3- workman/Satish Chandra Srivastava within a period of two months.
II. The respondent No. 3-workman/Satish Chandra Srivastava has agreed to accept the aforesaid amount as a full and final settlement of all dues claimed by him from the petitioners.
III. The amount of Rs.4 Lakhs shall be deposited by the petitioners in the following bank account at the request of respondent No.3-workman.

IV. The award shall not be implemented in view of the aforesaid settlement. The respondent No.3- workman shall not make any further monetary claim from the petitioner.
V. In case the petitioner-employer does not deposit the bank draft within a period of two months from today, it shall be open to the respondent No. 3- workman to file a recall application and also institute contempt proceedings, if so advised.
VI. The writ petition is disposed of in terms of the mutually agreed settlement/ compromise.
