O R D E R Learned counsel for the petitioner has filed a memo seeking withdrawal of the writ petition and the same reads as under;
“During the pendency of the above writ petition, in view of the “Sabka Vishwas – Legacy Dispute Resolution Scheme, 2019” the petitioner has filed an application before the Assistant Commissioner of Central Excise and central Tax Udupi for settlement of dispute pertaining to the service tax which is the subject matter of the above writ petition. The said application was heard and the orders reserved.
Wherefore the Hon’ble Court be pleased to permit the petitioner to withdraw the above writ petition reserving liberty to the petitioner to seek revival of the above writ petition in the event the petitioner’s application for settlement will be rejected in the interest of justice.”
2. Memo is placed on record. Permission granted.
Writ Petition stands dismissed as withdrawn with liberty as sought for.
