Heard learned counsel for the applicants and learned A.G.A. for the State.
Learned A.G.A. has pointed out that till date no charge sheet has been filed in the present case and only pursuant to the F.I.R. lodged in Case Crime No. 592 of 2018, under Sections 272 I.P.C. and Section 60 of Excise Act, PS-Khorabar, District-Gorakhpur, direction for court below has been sought to consider and decide the bail application of the applicants.
Accordingly, present application is disposed of with liberty that in case the applicants move an application for grant of bail, same shall be considered and decided by the courts below expeditiously after hearing the public prosecutor.
