Heard learned counsel for the petitioner.
The present petition has been filed for a direction upon the learned Civil Judge (Junior Division), Varanasi to decide Original Suit No. 497 of 2004 (Amarnath and others Vs. Basmati and others) within a stipulated period.
It is the case of the petitioner that his son has filed a suit against her with a prayer for permanent injunction in which an ex-parte interim injunction order was granted on 22.3.2005. It has been submitted that the petitioner is an old lady, aged about 94 years, therefore, a suitable direction be issued to decide the suit expeditiously.
Considering the facts of the case, the petition is disposed of with direction to the court below to decide suit expeditiously, preferably within a period of one year from the date of production of certified copy of the order without granting any unnecessary adjournments to either of the parties.
