JUDGMENT / ORDER

The petitioner complains about a latrine that has been constructed by the second respondent close to a public thodu. It is alleged that, the waste from the latrine is let out into the public thodu causing widespread nuisance and health hazards to the people living in the locality. The counsel for the petitioner places reliance on Exhibit P3 report of the Medical Officer to drive home his contention that, the latrine is liable to be demolished and removed to some other place. He has submitted Exhibit P4 complaint which is pending before the second respondent. He seeks the issue of appropriate directions for the consideration thereof. 2. In view of the limited relief sought, it is sufficient that this writ petition is disposed of directing the first respondent to consider Exhibit P4. In view of the above, I W.P.(C) No.34811 of 2014-K -:2:-
do not consider it necessary to issue notice to the respondents.
This writ petition is therefore disposed of directing the first respondent to consider Exhibit P4 complaint submitted by the petitioner, in accordance with law and in the light of Exhibit P3 report and if necessary, after conducting an inspection of the site and to pass final orders in the matter, after affording an opportunity of being heard to the petitioner as well as the second respondent, as expeditiously as possible and at any rate within a period of one month of the date of receipt of a copy of this judgment.
