Grievance is with regard to denial of increment for the period 2016 to 2021.
Learned Standing Counsel points out that petitioner was incarcerated in jail on account of his implication in a criminal case and disciplinary enquiry is also pending against him.
Petitioner has not disclosed as to what has been the outcome of the disciplinary enquiry. In such circumstances no direction can be issued for grant of increment to petitioner at this stage.
It shall however be open for the petitioner to approach the competent authority i.e. respondent no.3, who shall examine petitioner’s grievance with reference to applicable provisions of law and after consideration of material facts with regard to petitioner’s working and his rights.
Subject to the above observations, this petition is consigned to records.
