The petitioner, who was appointed Supervisor Kanoongo, finally retired on 31.05.2015. His claim is that his salary in the special pay scale of Rs.37,400-67,000/- with grade pay Rs.8700/- was not fixed w.e.f. 01.01.2015.
Accordingly, he is entitle to the arrears of the salary from 01.01.2015 to 31.05.2015 and that his pension is to be revised.
Since the matter involves factual aspect which cannot be ascertained in writ jurisdiction, we permit the petitioner to make a representation in this regard before the Principal Secretary Niyukti Anubhag-2, Government of U.P. Lucknow respondent No.1.
In case any representation is filed by him within a period of two weeks from today the respondent No.1 shall consider and decide it by a speaking order in accordance with law most expeditiously, if possible, within three months.
The Writ Petition is disposed of.
