It does not become clear as to why the complaint/incident was not straightaway registered as FIR and investigation was not commenced.

So as to enable the learned APP to take instruction and to inform the Court as to why, in the first instance, straightaway FIR was not registered and investigation was not commenced and also to explain how the order directing inquiry under Section 202 is justified, time is granted.

Let Notice be issued returnable on 16th January 2013.
