JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) It is an undisputed position that against the order which is the basis of the present petition under the Contempt of Courts Act, Letters Patent Appeal has been preferred being Letters Patent Appeal No.766 of 2012 and the same has been admitted and as stated by the learned counsel appearing for both the sides, the matter is pending and the application for interim stay is under consideration before the L.P.A Bench. Under these circumstances, we find that when the L.P.A Bench is seized with the proceedings, the present proceedings are not required to be continued, at this stage, with the liberty to the applicant to move this Court in the event the stay expressly refused by the L.P.A Bench or otherwise. The application is disposed of accordingly. Notice is discharged.
