(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) Learned Counsel for the appellants, Mr. Patel, states that the concerned record, which was to be re-audited, as per the order, is now destroyed totally and is not available. Therefore, the issue itself has now become infructuous. He stated that in view of the same, he is not pressing the present appeal, at this stage, with a liberty to apply in case of difficulty. Appeal stands DISPOSED OF as not pressed, accordingly.
Since, the main matter is disposed of, civil application shall not survive and it also stands DISPOSED OF, accordingly.
