Heard learned counsel for the parties.
In this case, a number of writ petitions have already been filed seeking the same relief and the relief sought is required to be adjudicated upon in consonance with each other. The issue involved pertains to Writ–C No. 26341 of 2019 and the matters are connected to Writ–C No. 26341 of 2019. Then, all these similar writ petitions should be heard together and a worthy order has already been passed by coordinate bench of this Court vide order dated 18.12.2020 in Writ–C No.23980 of 2020 and there are so many other orders regarding other writ petitions, which have been produced for perusal of this Court by Sri P.K. Sinha, learned counsel for the petitioner.
I have also heard Sri Vikas Budhwar, appearing for employee- respondent.
Let a counter affidavit be filed on behalf of respondent no.3 by Mr. Vikas Budhwar, on or before the date fixed.
Mr. Ishan Shishu has accepted notice on behalf of respondent nos.1 and 2. He may also file a return within the same period of time.
List this writ petition along Writ–C No.26341 of 2019 on 12.01.2021.
Meanwhile, operation of the impugned order dated 22.07.2020, passed by the Appellate Authority under the Payment of Gratuity Act, 1972/Deputy Chief Labour Commissioner (Central), Kanpur in Appeal No. K-36/59/2019-C.1, shall remain stayed.
