The petitioners claim to be Bhumidhar of the plot no. 636M measuring 0.1710 hectare situated at Village Anjana, Tehsil-Handia, District Allahabad. The petitioners were raising certain constructions, notice was issued to the petitioners by respondent no. 4 on 01.04.2017 on the basis of the complaint made by respondent no. 6 and in response to the said notice, Sub Divisional Magistrate, Handia respondent no. 3 passed an order dated 10.10.2017 stating that the construction is being raised on the land of P.W.D. The petitioners to the said notice, filed a response/objection which is stated to be received on 13.04.2017 but till date no orders have been passed and the Authorities are interfering in the possession of the petitioners.
Normally the rights of the petitioners can be decided only by way of competent jurisdiction but since a notice was issued by respondent no.4 and the petitioners have submitted his reply on 13.04.2017, his reply be considered and appropriate orders be passed by the Competent Authority, respondent no. 4 as far as possible within one month from the date of certified copy of this order.
The writ petition is disposed of.
