Admittedly, the appeal filed by the petitioner is pending before the Commissioner against the order of externment and a date has been fixed for hearing.
The Commissioner, Jhansi Division, Jhansi, before whom the aforesaid appeal is pending may make an endeavour to decide the appeal on the date fixed or in any case within the next 15 days.
If for some reason, not attributable to the petitioner, the matter cannot be decided finally within the next 15 days from the date fixed, it would be open to the petitioner to move a fresh stay application, which shall be considered afresh by the Commissioner, within a period of one week from the date of fresh filing of the stay application.
With the aforesaid observations the Writ Petition is disposed off.
