(Per : HONOURABLE MS.JUSTICE HARSHA DEVANI) This application seeks condonation of delay of 99 days caused in filing Miscellaneous Civil Application (Stamp) No.1393 of 2012 seeking review of judgment and order dated 9th July 2010 passed by this Court in Special Civil Application No.4846 of 2009.
A perusal of the judgment and order dated 9th July 2010 passed by this Court in Special Civil Application No.4846 of 2009 of which review is sought for, shows that this Court has merely followed its earlier judgment in the case of Indian Rayon v. State of Gujarat rendered in Special Civil Application No.11495 of 2009 (now reported in 2011(1) GLR 700). It is an accepted position that in the case of Indian Rayon v. State of Gujarat, a review petition came to be filed before this Court which subsequently came to be withdrawn. Under the circumstances, the question of entertaining the present application seeking review of judgment and order dated 9th July 2010 wherein the Court has merely followed its earlier decision in case of Indian Rayon, does not arise.
In the light of the fact that the Court is not inclined to entertain the review application, no useful purpose would be served in entertaining the present application for condoning the delay caused in filing the review application. The application is, accordingly, rejected.
