Heard learned counsel for the petitioner.
In view of the order proposed to be passed, notices need not go to the private respondents.
The petitioner is before this Court for a direction to the Additional District Judge, Court No.10, Bareilly, to decide the Additional District Judge, Court No.10, Bareilly to decide the delay condonation application and interim application both dated 02.07.2016 filed in Misc. Appeal No.123 of 2016 (Bareilly Development Authority, Bareilly Vs. Vishnu Kumar Agrawal and others) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Additional District Judge, Court No.10, Bareilly to consider and decide the aforesaid application in accordance with law on the next date fixed in the matter after hearing all the parties concerned. If on account of any reason no orders were passed on the aforesaid date, the decision will be taken on the aforesaid application preferably within a period of one month, thereafter.
