Affidavit filed today on behalf of the petitioner is taken on record.
Heard counsel for the parties.
The petitioner's prayer is that a direction be issued in the nature of mandamus commanding the opposite parties no.1 to 4 to stop the illegal construction being raised by the opposite party nos.5 & 6 over the land of School situated in Village-Raipurganj, Pergana and Tehsil Laharpur, District Sitapur.
The grievance raised in the writ petition can more appropriately be looked into by the District Magistrate.
We, therefore, dispose of the writ petition finally with the direction that the petitioner may make a representation to the District Magistrate, Sitapur and if such a representation is made, the same shall be considered and disposed of, expeditiously, in accordance with law, say within a maximum period of two weeks from the date a certified of this order is produced before him, after affording opportunity to the petitioner.
