Heard learned advocate Mr.Dipen Desai. Learned advocate invited attention of the Court to Annexure-A page-24 dated 30th March 2010. In the subject, it is mentioned that, 'it is a notice with regard to dismissal from service on account of cancellation of a 'caste certificate' describing the petitioner as a member of scheduled tribe'.
Learned advocate also invited attention of the Court to last two paragraphs wherein it is stated that the petitioner is liable to repay the amount of salary received by him from the date of his appointment i.e. 5th November 1979 till he reached the age of superannuation i.e. 31st May 2008 totalling to Rs.26,09,912=00.
The matter requires consideration. RULE. Notice as to interim relief returnable on 22nd November 2010. Ad-interim relief in terms of paragraph 6(c).
Direct service is permitted. It will be open for the learned advocate for the petitioner to effect direct service by registered post AD in addition to the regular mode of service.
