Heard learned counsel for the petitioner and Sri Kunal Ravi Singh, learned counsel for the respondents.
The instant writ petition has been filed against the impugned order of the respondent no. 1, by which the respondent no. 1 has imposed the penalty of Rs. 25,000/- upon the petitioner on the ground that the petitioner has provided information belatedly.
Having heard the learned counsel for the parties and after perusal of the record this Court finds that there is no reason to impose the penalty in the instant case because the petitioner has initially refused to grant the information as the information sought were related to a person individual. However an appeal was preferred, by which the petitioner was directed to provide the information. The requisite information were provided by the petitioner, hence the delay appears to be caused. The reasons for delay is acceptable and there was no malice on the part of the petitioner.
In view of the aforesaid, the writ petition is disposed of, the impugned order dated 02.06.2017 is quashed.
