Vide earlier order of this Court dated 11.09.2018, the Court has passed the following order:-
"Heard learned counsel for the petitioner, learned Standing Counsel for respondent No. 1 and Sri Ashok Kumar Lal, learned counsel appearing for respondent Nos. 2, 3 & 4.
Present writ petition has been filed for payment of suspension allowance from September 2017 to till date.
Case of the petitioner is that he was working as Cadre Secretary, Atm Nirbhar Sahkari Samiti Limited Kasba Farah District Mathura and vide order dated 06.07.2015 he was suspended but the suspension order has not been annexed along with the writ petition.
Learned counsel for the petitioner is directed to file supplementary affidavit annexing the suspension order dated 06.07.2015.
Sri Lal, learned counsel appearing for respondent Nos. 2, 3 & 4 is directed to seek instruction with regard to the status of inquiry and secondly as to why the suspension allowance has not been paid to the petitioner from September 2017 to till date.
Put up on 18.09.2018 as fresh."
Learned counsel for the petitioner has filed supplementary affidavit annexing the copy of suspension order dated 06.07.2015 which is taken on record.
Sri Ashok Kumar Lal, learned counsel for respondent Nos. 2, 3 and 4, on the basis of instruction, has informed that 28th September, 2018 is the date fixed for the meeting of District Administrative Committee on which date matter of petitioner shall be placed for final decision and in all eventuality, inquiry shall be completed within a month from today.
So far as the suspension allowance of the petitioner is concerned, the same shall also be paid to the petitioner within one month from today.
In light of statement made by learned counsel for the respondents, with the consent of parties, without adverting on the merits of the case, the writ petition is disposed of directing respondent No.4, The Member Secretary, District Administrative Committee (X-Cadre) and Secretary/Chief Executive Officer, Mathura to conclude the enquiry and also pay the suspension allowance strictly in accordance with law expeditiously, preferably within a period of one month from the date of production of certified copy of this order.
