Heard Sri Rajesh Nath Tripathi, learned counsel for the petitioner and Sri Abhishek Shukla, the learned Standing Counsel.
It is submitted by learned counsel for the petitioner that affidavits have been exchanged on the injunction application in a suit under Section 229-B of U.P.Z.A. & L.R. Act filed by the petitioner, ends of justice would be met, if an appropriate direction is issued to the respondent no.2 concerned, to dispose of the injunction application, preferably within a stipulated period.
The learned Standing Counsel submits that he has no objection if an appropriate direction is issued to the respondent concerned.
The writ petition is disposed of with the direction to respondent no.2 to make all sincere endeavour to dispose of the injunction application, subject to the cooperation of the parties concerned, as expeditiously as possible, preferably within 3 months from the date of production of certified copy of the order.
However, learned counsel for the petitioner undertakes that he shall not seek any adjournment and so also is expected from the private respondents, so that pending suit is disposed of as expeditiously as possible in view the observations of this Court made in Writ-C No. 6635 of 2012 (Chandra Bali Vs. Addl. Commissioner and others) decided on 7.2.2012.
