Sri Ratnesh Kumar Jaiswal, Advocate has filed his power on behalf of the opposite party no.2, along with counter affidavit which is taken on record.
Heard Sri Shyam Babu Vaish, learned counsel for the applicant, Sri Ratnesh Kumar Jaiswal, learned counsel for the opposite party no.2 and Sri G.P. Singh, learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed with the prayer to quash the entire proceeding in pursuance of compromise dated 5.8.2018 in complaint case no.304/2009, u/s 147, 420, 467, 468, 471, 120-B IPC, P.S. Shikarpur, district Bulandshahar arising out of summoning order dated 8.11.2005 pending before IInd Addl. C.J.M., district Bulandshahar.
It has been contended by learned counsel for the applicants that except applicant no.2, rest of the applicants have been granted bail by the competent court. The applicant no.2 is an old lady aged about 67 years. The dispute between the parties has been compromised outside the Court.
Learned counsel for the opposite party no.2 has admitted the compromise entered into between the parties.
Considering the submissions made by learned counsel for the parties, the applicants are directed to file an application along with the compromise within two weeks from today before the court concerned for deciding the compromise between the parties. Learned Magistrate after verifying the compromise from opposite party no.2, shall pass suitable orders within four weeks thereafter in accordance with the provisions of law.
For the period of six weeks, no coercive action shall be taken against the applicants in the aforesaid case.
With the aforesaid observations/directions, the application stands disposed of.
